Terms and Conditions for Artists - Fun Booking (גרסה בעברית מייד אחרי הגרסה באנגלית)
These terms and conditions govern the relationship between the artist ("Artist") and Fun Booking ("Agency"). By affiliating with Fun Booking, the Artist agrees to the following terms:
1. Artist's Independent Booking Activities
Artists affiliated with Fun Booking have the full right to leverage the provided press kit, accessible within the artist's profile (including high-resolution images, biography, music/DJ set links, and promotional media folders), to independently pursue and secure their own performance opportunities. For gigs independently secured by the Artist, defined as the establishment of a confirmed performance date and agreed-upon payment amount through their own direct efforts, no commission is payable to Fun Booking. However, to maintain professional standards and avoid potential booking conflicts (such as duplicate offers to the same venue), the Artist is required to promptly inform Fun Booking of all such confirmed bookings.
2. List of Regular Customers
A "regular customer" is defined as a venue, production company, or other entity with whom the Artist has successfully completed five or more paid performances within the twelve (12) months preceding their signing with Fun Booking. A comprehensive list of these regular customers must be submitted via email to [email address removed] within ten (10) calendar days of the Artist's official onboarding with Fun Booking. The email subject line should clearly state: 'Regular Customer List - [Artist Name]'. Artists retain ownership of their pre-existing, regular customer relationships and can continue managing these bookings independently without incurring Fun Booking commission. Furthermore, if a regular customer represents a new contact in general for Fun Booking, that contact may be utilized to book other artists within the agency's roster, reflecting a collaborative "all for one and one for all" approach in expanding booking opportunities. Artists also have the option to pass the business management of these regular customers to Fun Booking at their discretion, in which case standard commission rates will apply for any future bookings facilitated by the agency. Fun Booking is committed to maintaining the confidentiality of all customer information provided by its artists.
3. Commission on Fun Booking Gigs
Fun Booking "closing a gig" encompasses the process initiated by the agency that leads to a final, signed performance contract between the Artist and the client, outlining the date, time, location, and agreed-upon compensation. Fun Booking invoices and receives payment directly from the client. The Artist will receive seventy percent (70%) of the net income (excluding VAT) for these bookings. If the Artist is legally liable to add Value Added Tax (VAT) at the current rate of 18% (or as legally mandated), they will include this amount in the invoice they send to Fun Booking. Payment to the Artist will be made by Fun Booking within fifteen (15) calendar days of Fun Booking receiving the full payment from the client, provided that a valid invoice has been received from the Artist. Commission payments to the Artist will be made via [Specify preferred payment methods, e.g., bank transfer, PayPal, etc.].
4. Exclusivity within Israel
During their active affiliation with Fun Booking, Artists agree to grant Fun Booking exclusive booking rights within the geographical territory of Israel for Israeli-based clients and events. This exclusivity applies to any booking initiated or confirmed for performances taking place within Israel or for Israeli promoters, regardless of the Artist's physical location. Artists wishing to terminate this exclusivity and engage with another booking agency for opportunities within Israel must provide written notification of termination via email to [email address removed]. The Artist's profile will be removed from the Fun Booking website within thirty (30) calendar days from the date the termination email is received by Fun Booking. This exclusive arrangement within Israel allows Fun Booking to dedicate its full resources to maximizing booking opportunities for our artists in this region.
5. Trust Basis
We believe in fostering strong, trust-based relationships with our artists, prioritizing open communication and transparency over cumbersome contracts.
6. Fun Booking Client Ownership
A client relationship is considered to be established by Fun Booking when the agency has initiated contact, presented the Artist, negotiated the terms, and secured a confirmed booking (as defined in point 3 with a signed contract) for that client. Artists are obligated to direct any direct inquiries from clients with whom Fun Booking has previously established a booking to Fun Booking for all future engagements. Bypassing Fun Booking with its clients undermines this trust and may lead to the termination of our agreement.
7. Termination
Fun Booking reserves the right to terminate its affiliation with an Artist if the Artist fails to respect these terms and conditions.
8. Amendments
Fun Booking reserves the right to modify these Terms and Conditions at any time. Artists will be notified of any material changes via email to their registered email address. Continued affiliation with Fun Booking following such notification constitutes acceptance of the revised Terms and Conditions.

תנאים אלה מסדירים את היחסים בין האמן ("האמן") לבין פאן בוקינג ("הסוכנות"). על ידי הצטרפותו לפאן בוקינג, האמן מסכים לתנאים הבאים:
1. פעילויות בוקינג עצמאיות של האמן
אמנים המזוהים עם פאן בוקינג זכאים באופן מלא לנצל את קיט הפרסום המסופק, הנגיש בפרופיל האמן (כולל תמונות ברזולוציה גבוהה, ביוגרפיה, קישורים למוזיקה/סטים של דיג'יי ותיקיות מדיה לקידום), כדי ליזום ולהבטיח באופן עצמאי הזדמנויות הופעה משלהם. עבור הופעות שהובטחו באופן עצמאי על ידי האמן, המוגדרות כקביעת תאריך הופעה מאושר וסכום תשלום מוסכם באמצעות מאמציהם הישירים, לא תשולם עמלה לפאן בוקינג. עם זאת, כדי לשמור על סטנדרטים מקצועיים ולמנוע ניגודי אינטרסים פוטנציאליים בהזמנות (כגון הצעות כפולות לאותו מקום עבור אותו אמן), האמן נדרש להודיע מיד לפאן בוקינג על כל ההזמנות המאושרות הללו.
2. רשימת לקוחות קבועים
"לקוח קבוע" מוגדר כמקום הופעה, חברת הפקה או גורם אחר שאיתו האמן השלים בהצלחה חמש הופעות בתשלום או יותר במהלך שנים עשר (12) החודשים שקדמו לחתימתו עם פאן בוקינג. רשימה מקיפה של לקוחות קבועים אלה יש להגיש באמצעות דואר אלקטרוני לכתובת [email address removed] בתוך עשרה (10) ימי לוח שנה מיום הצטרפותו הרשמי של האמן לפאן בוקינג. נושא הדוא"ל צריך לציין בבירור: "רשימת לקוחות קבועים - [שם האמן]". האמנים שומרים על בעלותם על קשרי הלקוחות הקבועים הקיימים שלהם ויכולים להמשיך לנהל הזמנות אלה באופן עצמאי מבלי לשלם עמלה לפאן בוקינג. יתר על כן, אם לקוח קבוע מייצג איש קשר חדש באופן כללי עבור פאן בוקינג, ניתן יהיה להשתמש באיש קשר זה כדי להזמין אמנים אחרים ברשימת הסוכנות, המשקף גישה שיתופית של "הכל בשביל אחד ואחד בשביל הכל" בהרחבת הזדמנויות ההזמנה. לאמנים יש גם אפשרות להעביר את ניהול העסקים של לקוחות קבועים אלה לפאן בוקינג לפי שיקול דעתם, ובמקרה זה יחולו שיעורי העמלה הסטנדרטיים עבור כל ההזמנות העתידיות שיאורגנו על ידי הסוכנות. פאן בוקינג מחויבת לשמור על סודיות כל פרטי הלקוחות שמספקים האמנים.
3. עמלה על הופעות דרך פאן בוקינג
"סגירת עסקה" על ידי פאן בוקינג כוללת את התהליך שיזמה הסוכנות ומביא לחוזה הופעה סופי וחתום בין האמן ללקוח, המפרט את התאריך, השעה, המקום והתמורה המוסכמת. פאן בוקינג מוציאה חשבונית ומקבלת תשלום ישירות מהלקוח. האמן יקבל שבעים אחוזים (70%) מההכנסה נטו (ללא מע"מ) עבור הזמנות אלה. אם האמן חייב על פי חוק להוסיף מס ערך מוסף (מע"מ) בשיעור הנוכחי של 18% (או כפי שנקבע בחוק), הוא יכלול סכום זה בחשבונית שהוא שולח לפאן בוקינג. התשלום לאמן יבוצע על ידי פאן בוקינג בתוך חמישה עשר (15) ימי לוח שנה ממועד קבלת התשלום המלא מהלקוח על ידי פאן בוקינג, ובלבד שהתקבלה חשבונית תקפה מהאמן. תשלומי העמלה לאמן יבוצעו באמצעות [ציין אמצעי תשלום מועדפים, כגון העברה בנקאית, PayPal וכו'].
4. בלעדיות בישראל
במהלך תקופת שיתוף הפעולה הפעילה שלהם עם פאן בוקינג, האמנים מסכימים להעניק לפאן בוקינג זכויות הזמנה בלעדיות בשטח הגיאוגרפי של ישראל עבור לקוחות ואירועים שבסיסם בישראל. בלעדיות זו חלה על כל הזמנה שיזם או אישר ביצוע הופעות המתקיימות בישראל או עבור מקדמים ישראלים, ללא קשר למיקומו הפיזי של האמן. אמנים המעוניינים לסיים בלעדיות זו ולהתקשר עם סוכנות בוקינג אחרת עבור הזדמנויות בישראל חייבים למסור הודעה בכתב על סיום ההתקשרות באמצעות דואר אלקטרוני לכתובת [email address removed]. פרופיל האמן יוסר מאתר האינטרנט של פאן בוקינג בתוך שלושים (30) ימי לוח שנה מיום קבלת הודעת סיום ההתקשרות בדואר האלקטרוני על ידי פאן בוקינג. הסדר בלעדי זה בישראל מאפשר לפאן בוקינג להקדיש את מלוא משאביה למקסום הזדמנויות ההזמנה עבור האמנים שלנו באזור זה.
5. בסיס אמון
אנו מאמינים בטיפוח קשרים חזקים המבוססים על אמון עם האמנים שלנו, תוך מתן עדיפות לתקשורת פתוחה ושקיפות על פני חוזים מסורבלים.
6. בעלות פאן בוקינג על לקוחות
קשר לקוח נחשב כנוצר על ידי פאן בוקינג כאשר הסוכנות יצרה קשר ראשוני, הציגה את האמן, ניהלה משא ומתן על התנאים והבטיחה הזמנה מאושרת (כפי שהוגדר בסעיף 3 עם חוזה חתום) עבור אותו לקוח. האמנים מחויבים להפנות כל פנייה ישירה מלקוחות שאיתם פאן בוקינג יצרה בעבר הזמנה לפאן בוקינג עבור כל ההתקשרויות העתידיות. עקיפת פאן בוקינג עם לקוחותיה מערערת אמון זה ועלולה להוביל לסיום ההסכם שלנו.
7. סיום ההתקשרות
פאן בוקינג שומרת לעצמה את הזכות לסיים את שיתוף הפעולה עם אמן אם האמן אינו מכבד תנאים והתניות אלה.
8. תיקונים
פאן בוקינג שומרת לעצמה את הזכות לשנות תנאים והתניות אלה בכל עת. האמנים יקבלו הודעה על כל שינוי מהותי באמצעות דואר אלקטרוני לכתובת הדוא"ל הרשומה שלהם. המשך שיתוף הפעולה עם פאן בוקינג לאחר הודעה כאמור מהווה הסכמה לתנאים וההתניות המתוקנים.
